(WAVE/WKYT) – There are new developments in a lawsuit filed after the November 4, 2025 crash of a UPS cargo jet.
UPS flight 2976 was a MD-11F freighter that crashed during takeoff from Louisville Muhammad Ali International Airport. The flight was headed to Honolulu.
The crash killed the three crew members aboard the jet and 12 people on the ground. The lawsuit was filed by the family of Trinadette Chavez, one of the victims.
UPS tried to move the case to federal court, arguing its airline is based in Atlanta. But U.S. District Judge David J. Hale disagreed and has sent the case back to Kentucky state courts.
Hale found six of the top UPS airline officers, including its president, actually work out of Louisville, which makes Kentucky the company’s legal home.
In response to the court ruling, a UPS spokesperson said, “We remain deeply saddened by Flight 2976. Our focus continues to be on supporting those affected and working closely with the National Transportation Safety Board as the investigation continues.”
