(WKYT) – The family of John Hardwick reached a settlement Tuesday in a lawsuit filed against the city of Danville and the Danville Police Department, according to the family’s attorney.
Attorney Ephraim Helton claims excessive force was used in the October 2024 arrest of Hardwick, who suffered from dementia.
Hardwick died last month at the age 67.

Helton said a monetary settlement was reached but he is not able to disclose the amount.
Policy changes, officer training part of agreement
As part of the settlement, Helton said the mayor will present to the city commission a new policy and procedures for dealing with individuals with diminished capacity, including dementia. The city also agreed to send the appropriate police officers to crisis intervention training.
Helton said the settlement was reached following mediation that lasted all day Tuesday.
In a statement, Mayor James “JH” Atkins said that “On behalf of the City, the Mayor expresses his sincere apologies for these unfortunate events and his condolences to the family of Mr. Hardwick who has recently passed away.”
