(WKYT) – UPDATE: A not guilty plea was entered on James Farthing’s behalf following his Monday arrest.
The Commonwealth requested a cash bond of $100,000, a bracelet that would measure alcohol intake, and biweekly screenings for substance use.
“I’m aware of the unique circumstances; he’s probably going to be able to post that,” said a Scott County prosecutor.
Farthing’s legal representative asked for a $5,000 cash bond and asked that Farthing not be treated differently because people know of his winnings. His attorney claims Farthing is not a flight risk and no mentions of alcohol or other substances are in his arrest citation, making the bracelet and screenings unnecessary.
Farthing’s attorney pointed out that the victim was not present in court and declined an emergency protective order.
“He shouldn’t be treated differently just because of everyone’s knowledge of him,” the defense attorney said.
The commonwealth responded by saying their requested bond was not meant to treat Farthing differently, but instead to address his ongoing criminal activity and safety for the community.
His prior cases include a guilty plea to assaulting an officer, dropped burglary charges, and an open Fayette County case for leaving the scene of a crash.
Judge Sarah Hays Spedding set Farthing’s bond at $15,000 cash, saying the decision is based on his charges and risk level.
Farthing is required to wear a monitoring device with a buddy tag that will alert the victim if he comes near her.
“Yeah, I’m not going close to her,” Farthing told the judge after asking for clarification on the monitoring device.
The preliminary hearing is scheduled for Aug. 27 at 1:30 p.m.

Police say 51-year-old James Farthing was arrested Monday in Scott County after allegedly assaulting someone the day before.
The victim reported a verbal argument turned physical when Farthing began strangling her, police say.
Marks were visible on the victim’s neck, according to authorities.
Farthing is facing charges for first-degree strangulation and fourth-degree assault, both for domestic violence. His arraignment hearing is scheduled for July 28 at 1 p.m. in the Scott County District Court.
